Update you on what’s happened so far since KSMP formally entered bankruptcy, and outline KSMP’s plans going forward.
Walk you through the required proofs of claim and the voluntary questionnaire—and how they relate to any forms you may have already filed in the LeFever Mattson cases—so you can complete the forms with confidence.

The Bankruptcy Court has issued special procedures to attend this Friday’s hearing on the matters scheduled in the LeFever Mattson and KS Mattson Partners LP bankruptcy cases.

The hearing will now be held on Friday, July 25, 2025 at 12:30 p.m.

Like past hearings, this hearing will be a “hybrid hearing” meaning you can attend in-person or via Zoom. However, investors who want to attend this hearing virtually will need to take some additional steps.

Hello all,

A few things from the Committee.

We expect to have another town hall-like session (exact structure to-be-determined) in mid-July. We are going to try to do this in as low cost a way as possible-which probably means the Committee with one of the attorneys from PSZJ will present. Bankruptcy professional fees are generally crazy, so we want the professionals focused on where they can add the most value-the Committee can probably handle a good bit of the preparation and execution of the town hall.

Our hope is that by this next town hall we can provide you with a draft of terms of the overall plan of reorganization that the debtors (hand-in-hand with the Committee) will propose. What does that mean? Well put simply, we should end up with a pot of money from all of the ongoing asset sales. The plan of reorganization will provide the map between this pot of money and actual distributions to creditors and investors- i.e., who gets what and based on what logic. As you might imagine, the plan will need to address questions about substantive consolidation and Ponzi schemes that we have previously mentioned-both topics have required significant forensic accounting work. Investors and creditors will ultimately need to vote to approve a plan.

The recent bankruptcy filing of KSMP might complicate our work (though we see this filing as very positive) and delay the timeline for sorting all this out, but hopefully not-in any case, we will give you an update in mid-July.

Other key threads of activity include:

- Ongoing sales of property controlled by LM Corporation and the investment entities. You have probably seen some of these on the court docket-if you’re following those-and you should see many more in the coming weeks.

- Processing of the Proofs of Interest and Proofs of Claims submitted by investors. As you might imagine, these are very complicated, and PwC has tied many of them back to LM’s books and records or the 1059 account, but there are a significant number of loose ends that first need to be addressed before validating many of the claims or interests. LM created a very complicated world.

- KSMP / KM Involuntary Filings. I won’t go into any detail of the Committee’s professionals’ work on these matters, but we do see the KSMP consenting to the involuntary bankruptcy filing as a significant plus for investors.

That’s the short update. We all would like this to move more quickly, so we are doing our best to push things along. We greatly appreciate your patience as we proceed and look forward to giving you a more fulsome update in mid-July.

The United States Trustee has appointed an Official Committee of Creditors that includes six LeFever Mattson-entity investors. At the request of the Committee, the Bankruptcy Court has suspended the time for investors and creditors to file proofs of claim. As a result, investors do not need to expend resources at this time filing a proof of claim. The Committee is working with the Debtors to set a future deadline to file proofs of claim and establish clear instructions to help you submit one. You will receive notice of that new deadline after it is set in the coming months. For the avoidance of doubt, there is nothing for investors to do at this time with respect to filing a proof of claim.

In the future, you can expect the Committee to schedule a series of “virtual town halls” to keep you informed about the bankruptcy. After a new bar date is established, we will host a virtual town hall specifically designed to help you fill out and submit your proof of claim. This meeting will be recorded and posted for investors to view at their convenience.

The Committee will provide notice of these virtual town halls by filing a notice on the docket, sending emails to investors, and posting the schedule on this website.
