On July 15, 2015, each of the 23 Debtors filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The 23 cases (collectively, the "Bankruptcy Cases") are jointly administered under Case No. 15-02741 before the Honorable Judge Tamara O. Mitchell in the United States Bankruptcy Court for the Northern District of Alabama. On February 21, 2017, under the Conversion Order, the Chapter 11 Cases were converted to cases under Chapter 7 of the Bankruptcy Code.
Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. § 362), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owed prior to the commencement of the Bankruptcy Cases. If you believe that you might be a creditor of the Debtor(s) based upon debts arising prior to July 15, 2015 and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice. The Bankruptcy Administrator (the “B.A.”) held the initial meeting of creditors on August 20, 2015 at 1 p.m. CDT at the U.S. Bankruptcy Court, Robert S. Vance Federal Building, 1800 Fifth Avenue North, Birmingham, Alabama 35203 (the “Initial 341”). The B.A., the Debtors’ representative, and the Debtors’ local counsel appeared at the Initial 341 and the B.A. announced that the meeting of creditors was continued to SEPTEMBER 10, 2015 AT 1 P.M. CDT. There was no questioning of the Debtors’ representative at the Initial 341. There was questioning allowed at the continued meeting of creditors on SEPTEMBER 10, 2015 AT 1 P.M.
